General rules for use of the website hosted at www.suseia.be

The User confirms having received from SUSEIA all information and advice required for the correct use of the website accessible at www.suseia.be.

To order products and services through the website, the User must identify himself/herself by providing the username (login) and password that will be sent to him/her. The User is responsible for the confidentiality of his/her password and for any authorized or unauthorized use of his/her password. In case of doubt as to the confidential character of the password, the User shall promptly notify SUSEIA thereof in writing at the following e-mail address: support [at] suseia [dot] com.

The User is responsible for providing the necessary human and computer resources to ensure connectivity to the web site. The User shall therefore be solely liable for the deployment of the human and computer resources deemed appropriate for this purpose.

Access to the website is conditional upon acceptance of these general terms of use which may be changed at any time by SUSEIA by publishing change notifications directly on the website or by providing links to such notifications on the website. Any notification may also be sent to the User by e-mail or by post.

By accessing the website, the User agrees to provide accurate, up-to-date and complete information and to regularly update this information. Should the User fail to do so, SUSEIA shall be entitled to suspend or to terminate the account, or to refuse access to all or part of the website.

With respect to the use of the website, the User is expressly prohibited from:

posting, uploading, emailing or otherwise transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, threatening to the privacy of others, hateful, racist, or otherwise reprehensible;

consulting, posting, uploading, sending, or transmitting any content that violates applicable national and international laws;

attempting to mislead other users by usurping the name or the company name of other people;

uploading, posting, emailing or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright, or any other proprietary rights of any third party;

interfering with or disturbing the service, the servers or the networks connected to the service, or disobeying any requirements, procedures, policies, or regulations applicable to networks connected to the website;

harassing one or more other users in any way whatsoever;

SUSEIA represents and warrants that the elements, services and functions made available to the User, if used in accordance with the instructions provided, are generally in keeping with generally acknowledged standards, and that the software and all elements created by SUSEIA and made available to the user respect the rights of third parties, and more generally are not unlawful.

SUSEIA is generally bound by an obligation of means.

SUSEIA shall under no circumstances be held liable for any damage, direct or indirect, incurred by the User while using the website made available to him/her. Similarly, SUSEIA shall only be held liable for fraud or gross negligence. It shall not be held liable for fraud or gross negligence on the part of its employees, principals or more generally by its representatives.

The User shall also hold harmless SUSEIA from any claims in any of the following cases:

loss of business opportunities or income associated with the operation or lack of operation, or with the use or lack of use of the website, or of the content to be found or supposed to be found on the website;

unlawful or unauthorized intrusion by any third party into the Web server or website of SUSEIA;

introduction of a computer virus into the Web server or website of SUSEIA;

temporary blocking of the bandwidth;

interruption to the Internet connection service for a reason beyond SUSEIA’s control.

The user acknowledges that the functions presented on the website are subject to change. Therefore, certain functions may be deleted and others added, and the user may not consider access to a particular feature an acquired right. Similarly, SUSEIA alone will decide when to include/delete any content presented on the website.

SUSEIA reserves the right, at any time and for any reason whatsoever, to modify or temporarily or permanently suspend full or partial access to the website without prior notification of the User.

Such will be the case, for example, during maintenance of the website or in case of major changes to the relevant services and/or functions. SUSEIA cannot be held liable for any direct or indirect damage arising out of the modification, suspension or interruption of access to the website, for any reason whatsoever.

The User is granted a non-transferable right to use the website and its content exclusively for personal purposes. This right is granted for the duration of validity of the username and the password that the User will receive from SUSEIA.

The information, logos, artwork, brands, models, slogans, charts, etc. accessible via the website are protected by intellectual property and/or industrial property rights.

Except as expressly authorized by SUSEIA and/or the third party concerned, the user is not authorized to modify, copy, rent, borrow, sell, distribute or create derivative works based in full or in part on the elements presented on the website. It is consequently forbidden (and the user may not authorize any other party) to copy, modify, create a derivative work, reverse the design or assembly or in any other way attempt to find the source code, sell, attribute, sub-license or transfer any right attached to the website and its content.

Any disputes shall be governed by Belgian law and the Courts of the judicial district of Brussels shall have sole jurisdiction.
